ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail to
the applicant Jamil Sikandar Mulla in C.R.No.4 of 2022 of Railway

Protection Force, Post Andheri, Mumbai for the offence punishable
U/s.3 Railway Property (Unlawful Possession) Act.

Allegation against the applicant is that on 06/04/2022,
there was theft of the Chair Arms Rest approximately 52 kilos
worth Rs.1200/- a railway property. Three accused were arrested
on the basis of CCTV footage and they informed that they have sold
the property to the applicant. Applicant is receiver of the stolen
property.

Considering the nature of offence and punishment
prescribed for the offence, I am inclined to allow the application.
Hence, I pass following order.
ORDER

Bail Application No.827 of 2022 is hereby allowed.

Applicant Jamil Sikandar Mulla in C.R.No.4 of 2022 of
Railway Protection Force, Post Andheri, Mumbai for the offence
punishable U/s.3 Railway Property (Unlawful Possession) Act be
released on bail on executing PR bond of Rs.25,000/- with one or
more sureties of the same amount.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail before the Court attending remand.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
