ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail
to the applicant Indravijay Krishnakumar Singh in C.R.No.26 of
2021 of West Region Cyber Crime Police Station, Mumbai(Juhu
Police Station C.R.No.344 of 2020) for the offence punishable

U/s.420 of Indian Penal Code(hereinafter referred to as IPC) and
U/s.66(C), 66(D) of Information Technology Act.

Perused the application. Heard both the sides.

As per case of the prosecution, informant is Harshad
Kantilal Patel. He lodged FIR on 21/10/2020 that on 15/02/2020,
he received phone call from mobile No.9911843557 and the
speaker introduced himself as Rahul Sharma resident of Noida,
Delhi.

He informed to the informant that he has received
Rs.4,50,000/- of the insurance of the informant and he instructed
to deposit Rs.21,000/- at Indusind Bank giving details of the bank
account. Accordingly, on 17/02/2020, informant deposited the
amount through RTGS. Thereafter, again and again, he instructed
to deposit the amount and relying on his words, informant
deposited the amount of Rs.50,77,000/- from February 2020 to
01/10/2020.

Thereafter, he noticed that he has been cheated.

Therefore, informant lodged FIR. Applicant is owner of that bank
account. Applicant was arrested on 29/10/2021. Since then, he is
behind bars. Investigation is over and chargesheet is filed. There is
one criminal antecedent against the applicant of similar nature
bearing C.R.No.41 of 2021 registered at Anand Nagar Police
Station, Usnamanabad in which he has been released on bail.

Maximum punishment prescribed for the offence
levelled against the applicant is seven years. Applicant is resident
of out of Maharashtra and therefore, considering the amount

involved in the crime and nature of crime, applicant requires to be
directed to attend the concerned police station on 1st of every
month in between 11.00 a.m. to 2.00 p.m. till conclusion of the
trial. Considering the fact that investigation is over, chargesheet is
filed and this is an application for grant of regular bail, I am
inclined to allow the application. Hence, I pass following order.
ORDER

Bail Application No.201 of 2022 is hereby allowed.

Applicant Indravijay Krishnakumar Singh in C.R.No.26
of 2021 of West Region Cyber Crime Police Station, Mumbai(Juhu
Police Station C.R.No.344 of 2020) for the offence punishable
U/s.420 of Indian Penal Code and U/s.66(C), 66(D) of Information
Technology Act be released on bail on executing PR bond of
Rs.1,00,000/- with one or more sureties of the same amount.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail be furnished before the Court attending remand.

Applicant to attend the West Region Cyber Crime Police
Station, Mumbai on 1st of every month in between 11.00 a.m. to
2.00 p.m. till conclusion of the trial.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the

facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
