1.

This is an application under section 439 of Cr.P.C. for bail by
applicant/accused Imran Ahmed Bashir Ahmed Shaikh @ Imran, in
crime No.429/2021 under sections 307,326,324,504,506 r/w 34 of IPC
and sections 37(1)(A),135 of Maharashtra Police Act, registered at
police station Shivaji Nagar, Mumbai.

Mr. Ajay Tripathi Advocate for applicant/accused has submitted
that applicant is innocent and he has not committed any crime. There is
no recovery at the instance of accused. The antecedents of accused are

clear and he is ready abide by the conditions, if any imposed by the
Court. Further, co­accused are released on bail. Charge­sheet is filed.
He, prayed to release the applicant/accused on bail.

Mr. Ramesh Siroya, APP for the State has submitted that offence
is serious and if the accused is released on bail then he will abscond. He
prayed to reject the application.

Offence punishable under section 307, 326,324,504,506 r/w 34
of IPC and sections 37(1)(A),135 of Maharashtra Police Act, is
registered against the accused. The incident took place on 15/2/2021.
it is alleged that accused assaulted the complainant by bamboo and
sword. Police investigated the crime and filed charge­sheet. Co­accused
are released on bail. Present accused is arrested on 30/3/2022. He was
in police custody. However, nothing was recovered from the accused.
The antecedents of accused are clear and he undertakes to abide by the
conditions if any imposed by the Court. The role attributed to the co­
accused and present accused is same. Hence, considering the facts and
circumstances of the case and the principle of parity I, find that accused
is entitled for bail. Therefore, following order.
ORDER
1.

Bail Application No. 823/2022 is hereby allowed.

Applicant/accused namely Imran Ahmed Bashir
Ahmed Shaikh @ Imran, in C.R.No.429 of 2021
registered with Shivaji Nagar police station for the
offence punishable under Sections 307,326,324,504,
506 r/w 34 of IPC and sections 37(1)(A),135 of
B.A.823/2022

Order
Maharashtra Police Act, shall be released on his
executing PR Bond of Rs.20,000/­ (Twenty
Thousand only) with one or more sureties of the like
amount on the conditions that :­
a)
He shall attend the dates of Court regularly unless
exempted by the Court.

He be released on provisional cash bail of Rs.20,000/­.
Duration of provisional cash bail shall be for four weeks.

4.

Bail before Ld. Magistrate.

5.

Bail Application No.823/2022 is disposed of accordingly.
