ORDER
1
This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail to
the applicant Himmatsingh Mohansingh Baliya in C.R.No.9 of 2022
of L.T. Marg Police Station, Mumbai for the offence punishable
U/s.381, 201, 411, 120B, 212 r/w. 34 of Indian Penal Code.

As per case of the prosecution, informant is Khushal
Rasiklal Tamka, a gold smith. On 14/01/2022 at 1.30 a.m., servant
of the informant namely Ganesh Hiraram Kumar removed gold
ornaments from the locker of the office of the informant and cash
amount total Rs.8,19,37,871/-. Said Ganesh committed offence in
colusion with co-accused Ramesh Prajapati. Both the accused were
arrested. Muddemal is recovered from them. Allegation against
the applicant is that he received the property knowingly that
property is involved in the offence. Property received by him is
recovered from him. Investigation is over and chargesheet is filed.
Applicant is arrested on 21/01/2022.

Considering
the
nature
of
offence,
punishment
prescribed for the offence, I am inclined to allow the application.
Applicant is resident of Rajasthan. Therefore, in order to secure
presence of the applicant, following order will suffice the purpose.
ORDER
1
Bail Application No.871 of 2022 is hereby allowed.

Applicant Himmatsingh Mohansingh Baliya in C.R.No.9
of 2022 of L.T. Marg Police Station, Mumbai for the offence
punishable U/s.381, 201, 411, 120B, 212 r/w. 34 of Indian Penal
Code be released on bail on executing PR bond of Rs.25,000/- with
one surety of the same amount. In addition to this, applicant to
deposit cash surety of Rs.25,000/-.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail before the Court attending remand.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
