Perused application, reply and record. Heard parties.

The accused has allegedly assaulted his fiancee suspecting
her betraying him. The incident has occurred on 9/5/2022 at 05:30
p.m. during which the accused slapped her and also snatched away her
mobile phone. He also said that since the phone contained proof about

his relationship with her he would not give it back to her. Seeing his
aggression she fled away and went to Bandra police station. On her
apprising the incident to police an offence under Section 392 of The
Indian Penal Code was registered. Later the accused was arrested and
mobile phone in question was also recovered.

All the material investigation is already over. The accused
is in custody since 10/5/2022. There appears absolutely no ground to
justify further detention of the accused who is quite young and has no
criminal antecedents. In view of the apprehension of the prosecution
that he may pressurize the informant certain conditions can be imposed.
Hence the order :­

Application is allowed.

Accused Faiz Afasar Khan arrested in Crime Number 765/2022
under Section 392 of the Indian Penal Code registered at Bandra
police station be released on P.B. and S.B. of Rs. 15,000/­ subject
to conditions that he shall attend the said police station as and
when called by the Investigating Officer till filing of the charge­
sheet.

He shall not contact the informant in any manner either by
himself or through anybody else in respect of this case until
further orders.

He shall not tamper with the prosecution witnesses and evidence
in any manner.

Provisional cash bail in the like amount is allowed. The accused
shall furnish surety within 4 weeks from the date of release
failing which the cash bail shall stand forfeited without any
separate order to that effect.
