ORDER
Having got his bail application u/s.439 Cr.P.C.
rejected on 18/05/2017, the accused has filed this second bail
application. The accused is arrested u/s.120­B of IPC r/w. Section
7, 8 of Prevention of Corruption Act. The allegation against the
accused are that he was caught red handed when he collected
bribe amount of Rs.1.25 crores from the accused no.1 who had
promised the complainant for settlement of a case of the
complainant
with
Enforcement
Directorate
for
bribe
of
Rs.10 crores. The accused is a private person.

It is contended that the accused is falsely implicated.

He has no direct or indirect connection with the crime.

It is
contended that after accepting the bribe, he was called by accused
no.1 and as such, it cannot be said that he has conspired with
accused no.1.

The application is opposed on the ground that the
investigation is at crucial stage and the nature of the offence is
serious.

The complicity of ED officer in the offence is being
probed.

Heard advocate for the accused and SPP Shri. Bagoria
for CBI.

As stated earlier, this is the second bail application.

However, no change in the circumstance, sufficient to grant bail,
are brought on record. The first bail application is rejected on the
ground that the investigation is at crucial stage and no substantial
change in the circumstance has occurred since then. The grounds
mentioned in this application were already considered while
rejecting the first bail application of the accused. As such, I hold
that the accused need not be granted bail at this stage. Hence the
order.

The bail application is rejected.
