ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail to
the applicant Deepak Ashok Pawar in C.R.No.90 of 2022 of Wadala
Police Station, Mumbai for the offence punishable U/s.326, 120B,
506(II) r/w. 34 of Indian Penal Code.

Perused the application. Heard both the sides.

As per case of the prosecution, informant is Arjun
Gupta. Applicant is a well known criminal in the locality. There
was dispute between him with the applicant. On 30/03/2022 at
8.00 p.m, three unknown persons assaulted him with iron road and
sugar cane stick. He sustained bleeding injury to the his head.
Thereafter, on 31/03/2022, he lodged FIR against the applicant
and three unknown persons. Three unknown persons are yet to be
arrested. Applicant is not one of the assailants but as per case of
the prosecution and statement of the eye witnesses, at the instance
of applicant, those three unknown persons assaulted the informant.
Applican was arrested on 05/04/2022. Since then he is behind
bars. As per FIR itself, injured was discharged from the hospital on
the same day and he lodged FIR on the second day evening.
Applicant is having criminal antecedents. However, that cannot be
a sole ground to reject the application. Considering the the above
facts,
I am inclined to allow the application.

Hence, I pass
following order.
ORDER

Bail Application No.973 of 2022 is hereby allowed.

Applicant Deepak Ashok Pawar in C.R.No.90 of 2022 of
Wadala Police Station, Mumbai for the offence punishable U/s.326,
120B, 506(II) r/w. 34 of Indian Penal Code be released on bail on
executing PR bond of Rs.15,000/- with one surety of the same

amount. In addition to this, applicant to deposit cash surety of
Rs.15,000/-.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail before the Court attending remand.

Applicant to attend Wadala Police Station, Mumbai on
every Monday in between 11.00 a.m. to 2.00 p.m. till further
orders.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
