ORDER
1.

By the present application, the applicants/original accused
Nos.1 to 4 prayed to grant bail. The applicants/original accused have
been convicted by the learned Metropolitan Magistrate, 7th Court,
Dadar, Mumbai, vide
impugned
judgment
and
order
dated
16/01/2024 in C.C. No.1603/SS/2016.

Heard the learned Advocate Mr. Sunil D’Souza, who

submitted that he has strong hopes to succeed in the appeal. Hence,
prayed
to
release
the
applicants/accused
on
bail,
as
the
applicants/accused were on bail during the period of trial, and the
applicants/accused have challenged the legality of the impugned
judgment of conviction by filing the appeal.

Considering the same, as the substantive sentence is
suspended subject to payment of 20% of the cheque amount, I am
inclined to pass the following order :­
ORDER
1.

Criminal Bail Application No.335 of 2024 is allowed.

2.

The applicants/accused No.2. Nupur Saxena, 3. Rachna Saxena
and 4. Sundeep Saxena shall be released on bail on executing P.B. and
S.B. of Rs.1 Lakh each.
3.

The applicants/accused shall not protract the trial of the appeal
and shall attend the dates of the appeal regularly without any default,
else bail would stand cancelled for flouting the condition of bail bonds.
4.

The applicants/accused may remain absent for the genuine
reasons on giving well in advance intimation in the Court.
5.

Criminal Bail Application No.335 of 2024 is disposed of.
