This is an application for bail under Section 439 of
Cr. P.C. Heard Ld. Advocate for the applicant and Ld. APP for
the State. Perused documents on record.

The Ld. Advocate for the applicant submitted that
on the information of informant Siraj Ahemad Shaikh Crime
No.231/2022
is
registered
against
the
applicants
on
25.04.2022 for the offence punishable under Sections 504,
323, 324, 326, 34 of IPC. It is his further submission that
though offence under Section 326 of IPC is registered against
the applicants, prima facie no grievous hurt is caused to the
informant. He further submitted that incident suddenly
occurred due to dispute of place of business. In view of
medical papers on record, informant is discharged from the
hospital. Hence, in such circumstances, there is no need for
further detention of applicant. Hence, he prayed for grant of
bail.

Ld. APP filed say Exh.2 and opposed the application
on the ground that informant and applicants are relatives and
there is possibility of tampering of witnesses if the applicants
are released on bail. Hence, prayed for rejection of the
application. Ld. APP also admitted that there is no grievous
hurt caused to the informant as required to offence punishable
under Section 326 of IPC.

In view of submissions from both the sides and on
perusal of medical papers, it is clear that there is no grievous
hurt caused to informant. Offence is occurred due to sudden
fight between parties. Parties are acquainted with each other.
Material investigation is completed. Trial will take its own time.
Hence, in this situation, in my opinion, detention of applicant
for indefinite period cannot be warranted.

ORDER
1.

Criminal Bail Application No. 1046 of 2022 is allowed.

2.

Applicants/accused No.1 Arman Ijhar Ahmad and No.2
Gufran Ali Arman Ali Khan be released on bail on
furnishing P.R. Bond of Rs.15,000/- along one surety of
like amount each in connection with C.R. No.231/2022
registered with Wadala T.T. Police Station for the offences
punishable under Sections 504, 323, 324, 326, 34 of IPC.

station on notice by Investigating Officer.

Applicants/accused shall furnish their residential address
proof and contact numbers to Investigating Officer.

5.

The applicants/accused shall not directly or indirectly,
make any inducement, threat or promise to any person

him from disclosing such facts to the Court or to any
Police Officer.

6.

Applicants/accused shall not leave India without the
previous permission of the Court.
