ORDER
1.

This is an application filed by the accused u/sec.439 of
Criminal Procedure Code for releasing him on bail.
2.

The applicant / accused is prosecuted in C.R.No.483/2022
for the offences punishable u/sec.380 r/w 34 of IPC.

The applicant / accused contended that he is an interior
designer and innocent person. He has been falsely implicated in the
crime. The informant tried to run away from the liability to pay sum of
Rs.2 lakhs which is due towards informant of the interior designer work
done by the applicant / accused. The allegations leveled against the
applicant / accused are totally baseless. The photographs filed on record
clearly shows that all the house hold articles were removed from the
house as it is totally vacant. The interior design work in the alleged
house was going on and there is no possibility of keeping any bag of
valuables at the said work place. It is further alleged that applicant /
accused was arrested on 07.07.2022 therefore, prayed for releasing him
on bail.

The prosecution opposed the application on a ground that
if accused released on bail there will be threating to the prosecution
witnesses so also if, accused released on bail the stolen articles will not
be recovered Hence, prayed for rejection of the application.

Perused application, say filed by the prosecution. Heard
both the advocates at length.

The applicant / accused filed on record photographs of the
alleged house. The photograph shows that entire interior work of the
alleged house was going on and it also shows that entire articles were
removed from the said house. It is a matter of record that applicant /
accused is an interior designer and admittedly his four­five workers
were doing work at the house of informant.

The applicant / accused specifically mentioned that falsely
he has undergone police custody but nothing was seized from the
possession of the applicant / accused. The police has recorded the
statement of witnesses so, it is unwarranted and unnecessary to keep
applicant / accused behind the bar for indefinite period. I have gone
through the copy of FIR therein it is vaguely mentioned that silver glass,
dishes were kept in a bedroom and it was stolen from there but no exact
details were given. Therefore, in my opinion applicant / accused is
entitled to release on bail. Considering, this I pass the following order :
ORDER

Bail Application No.1786 is allowed.

Applicant / Accused Anurag Madhukar Lahankar arrested in
CR.No.483/2022 under Section 380 r/w 34 of IPC registered at Shivaji
Park Police Station be released on P.B. and S.B. of Rs. 50,000/­ with
one or two surety/s.

The accused shall not tamper with the prosecution witnesses and
evidence in any manner.
4]
He shall attend the concerned police station on every sunday
between 07:00 p.m. to 09:00 p.m. till further order.

Provisional cash bail in the like amount is allowed. The accused
shall furnish surety within 4 weeks from the date of release from jail
failing which the cash bail shall stand forfeited without any
separate
order to that effect.

Bail before the learned Trial Court.
