This is an application for bail under Section 439 of Cr. P.C.
Heard Ld. Advocate for the applicant and Ld. APP for the State. Perused
documents on record.

The Ld. Advocate for applicant submitted that applicant is
arrested by police in connection with C.R. No.20/2022 registered by
Cyber West Division Police Station, for the offence punishable under

Sections 419, 420, 467, 384, 504, 506, 509, 500, 120(B), 201 r/w 34 of
IPC and Sections 66(C), 66(D), 67, 67(A) of Information Technology
Act. It is contention of applicant that, he is in custody since 07.01.2023.
Investigation of the case is completed and charge sheet is filed by
police. It is further his contention that, he is falsely implicated in case.
Nothing is to be seized or recovered at the instance of applicant.
Applicant is ready to abide any condition imposed by this court. It is
also contended that, recently he is injured in jail and his treatment is
not possible as it require treatment from expert doctors. Hence, prayed
for grant of bail.

Ld. APP and investigating officer opposed application. It is
their contention that active role of applicant is found during
investigation. Applicant is beneficiary of crime proceed. If applicant is
released on bail there is possibility of tampering of evidence of
prosecution.

Further investigation is in progress. Hence, prayed for
rejection of application.

In view of submissions from both sides it is clear that,
charge sheet is filed against applicant. Further account of applicant is
seized by the police during investigation. Some amount is also paid to
the informant. In such circumstances, if presence of applicant is
required during further investigation it can be secured by imposing
conditions. At present further detention of applicant is not required.
Hence, I pass the following order :ORDER
1.

Criminal Bail Application No.21 of 2024 is allowed.

2.

Applicant/accused Anuj Kumar Baleshwar Sah be released on bail
on his furnishing P.R. Bond of Rs.50,000/- along with one or two

sureties of like amount in connection with C.R. No.20/2022
registered with Cyber West Division police station.
3.

Applicant/accused shall attend Cyber West Division police station
on notice of investigating officer.

4.

Applicant/accused shall furnish his residential address proof and
contact numbers to Investigating Officer.

5.

Applicant/accused shall not directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts
to the Court or to any Police Officer.

6.

Bail before Ld. Court below.

7.

Criminal Bail Application No.21 of 2024 stands disposed of
accordingly.
