This
is
an
application
for
regular
bail.

The
respondent/State resisted it by filing say at Exh.2. Read the application
and say. Heard both sides. Perused the record.

Crime No.266 of 2022 registered with Dharavi police
station alleges that on 30/03/2022, at about 10.30 p.m., the first
informant was selling vegetables as usual. The accused had come there
and purchased the vegetables of Rs.15/- and gave currency note of
Rs.100/-. The first informant returned Rs.85/-. However, later on, it is
revealed that currency note of Rs.100/- was fake. Therefore, the
accused was caught and police were called. In the meanwhile, the
accused abused the first informant and other persons. After her search,
36 currency notes of Rs.100/- found with the accused. Similarly, 3 fake
currency notes of Rs.100/- were found. Similarly, other currency notes
and coins worth of Rs.1,220/- were also found. On such report, the
crime is registered under Sections 420, 489-B, 489-C, 504 of the Indian
Penal Code.

Learned Advocate for the applicant submitted that the
applicant is resident of Parner Taluka and she had some dispute with
her family members. Therefore, she came to Mumbai, in anger. He
further submitted that she had 2 currency notes of Rs.2,000/-, but no
one was giving her change. In her attempt to get change, one unknown
person handed over the change of Rs.4,000/-. He further submitted
that she had no knowledge that some of the currency notes were fake.
Therefore, according to him, the applicant is victim and has committed
no offence. So far as these submissions are concerned, they are in the
nature of defence and without any material to support them. Therefore,
they cannot be considered at this stage.

It is true that the applicant cannot be denied bail only
because she is permanent resident of outside Mumbai. However, it may

be noted that offence under Section 489-B of the Indian Penal Code is
punishable with life imprisonment. It is grave and serious offence. The
investigation is still at initial stage. Learned A.P.P. submitted that the
applicant has not co-operated with police. Her associates are yet to be
revealed and arrested. Considering the nature of offence, there is every
possibility that she would abscond, if released on bail. Considering all
these factors, I am of the opinion that this is not a fit case for granting
bail. The application deserves to be rejected. Accordingly, I pass the
following order :ORDER
Bail Application No.824 of 2022 is rejected and disposed of accordingly.
