ORDER
The applicant / accused has preferred this application
under the provisions of Section 439 of Cr.P.C. in Crime No. 29 of 2024
registered with Tardeo Police Station under Section 366 read with
Section 34 of the IPC.

As per the applicant / accused, the mother of victim lodged
missing report on 13.01.2024 contending that 19 years old victim is
studying at London and came to India for Christmas Vacation. On
13.01.2024, she was returning to London and left for airport at 10.30
am. On the way, she got down to get some articles and left in Taxi
without informing the complainant and others. Hence, the missing
report was lodged showing apprehension that one Bajrang Maurya and
his friends might have taken the victim with intention to marry her.

During investigation, applicant / accused was arrested on
24.01.2024 and he was remanded to judicial custody on 01.02.2024. As
per the prosecution, mobile phone and gold ornaments worth
Rs. 9,50,000/- were seized from accused during investigation. Accused
contends that he is falsely implicated in the offence. He has not
instigated or forced the victim.

The victim was having affair with
Bajrang Maurya. Applicant contends that he is ready to abide the terms
and conditions of bail, if imposed on him.

Prosecution resisted the application by filing Say Exh. 02,
in which it is contended that the Statement of Victim u/s. 164 of Cr.P.C.
is recorded, wherein she has stated that she willingly went with Bajrang
Maurya. Hence, prosecution contends that necessary orders be passed.

Victim appeared and filed her Say at Exh. 03. She stated
that she has no objection to release this applicant / accused on bail.
Further, the victim has stated that she has performed marriage with
Bajrang Maurya on 15.01.2024 and willingly handed her jewellery to
this accused to take care.

Heard learned counsel for the applicant / accused, learned
APP for State and victim. Perused the copy of Remand papers,
complaint and Remand orders.

Admittedly, the accused is in judicial custody since
01.02.2024. Recovery is already done and nothing more is shown to be
recovered or discovered at the hands of this applicant for which his
custodial interrogation would be required.

Therefore, no purpose
would be served by keeping the applicant / accused behind bars.

Hence, accused is entitled to be released on bail by imposing conditions.
With this, I pass following order ORDER
1.

The Bail Application No. 407 of 2024 is hereby allowed.

2.

The accused Ajitkumar Radheshyam Maurya in CR
No. 29 of 2024 registered with Tardeo Police Station, he be
released on executing PR Bond of Rs. 25,000/-(Rupees
Twenty Five Thousand) only, with one of more solvent
sureties of like amount.
3.

The accused is directed to visit Tardeo Police Station on
4th Saturday of every month between 4.00 and 6.00 pm and to
maintain the diary in that respect till filling of charge-sheet.

The accused shall submit the proof of his residence,
Aadhar Card, Election card, if any.
5.

The accused shall not involve in any crime.

6.

The accused shall not tamper with the evidence of
prosecution.
7.

The accused shall not directly or indirectly make any
inducement, threat or promise to any person acquainted with
the facts of this case so as to disuade him / her from
disclosing such facts to the Court or to the police officers.

Breach of any condition will amount to cancellation of
bail forthwith.
10.

The Bail Application No. 407 of 2024 stands disposed
off.
