ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail
to the applicant Ajimullah Mashuqali Shaikh @ Shah @ Hajimullah
Masuqali Shah in C.R.No.561 of 2021 of Wadala Police Station for
the offence punishable U/s.353, 332, 506(II), 504 of Indian Penal
Code(hereinafter referred to as IPC) and U/s.142 of Maharashtra

Perused the application. Heard both the sides.

Informant Subhash Avhad is working in BMC as driver
on vehicle for collection of garbage. On 16/12/2021, he parked his
vehicle at Dinbandhu Nagar, Wadala(E) for collection of garbage.
At that time, applicant abused in filthy language saying he parked
his vehicle on road. Applicant also assaulted on him and another
employee. Applicant is arrested on the same day. Since then, he is
behind bars.

There are 19 criminal antecedents against the
applicant. However, that cannot be a sole ground to reject the
application. Considering the facts and circumstances of the case, I
am inclined to allow the application. Hence, I pass following order.
ORDER

Bail Application No.159 of 2022 is hereby allowed.

Applicant Ajimullah Mashuqali Shaikh @ Shah @
Hajimullah Masuqali Shah in C.R.No.561 of 2021 of Wadala Police
Station for the offence punishable U/s.353, 332, 506(II), 504 of
Indian Penal Code and U/s.142 of Maharashtra Police Act be
released on bail on executing PR bond of Rs.25,000/- with one or
two sureties of the same amount.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail be furnished before the Court attending remand.

Applicant to attend Wadala Police Station, Mumbai as
and when called by the investigating officer.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
