Applicant/accused seek his release on bail under Section
439 of Cr. P.C. in connection with C.R. No. 133/2022 registered with
Antop Hill Police station for the offence punishable under Sections 392,
504 r/w 34 of Indian Penal Code.

Prosecution allegation reveals that on 8.04.2022 at around
10.00 a.m. informant was driving the Tempo from Antop Hill to Dadar.
When the Tempo reached at Sion Koliwada bridge, at that time, bike
rider way laid him and hurled abuses. At that time, the applicant/pillion

rider stealthily took away the mobile of the informant and started
fleeing away from spot. Due to timely intervention of the police, both
the accused were nabbed then and there and mobile phone is recovered
from them. Eventually, aforesaid crime is registered.

Heard both the sides and perused the application, its
annexure and police report Exh.2.

On going through the investigation papers, it appears that
the applicant is nabbed red handed. The stolen mobile is recovered
from the applicant. Since 8.04.2022 the applicant is behind bar. No
criminal antecedent has been demonstrated against the applicant. The
investigation is considerably progressed and further incarceration of
applicant is unwarranted. Considering the nature of accusation and
progressed investigation, the applicant is released on bail on stringent
conditions. Hence, the following order :­
ORDER
1.

Criminal Bail Application No. 940 of 2022 is allowed.

2.

Applicant/accused Abdulla Shamsulla Mansuri be released on bail
on his furnishing P.R. Bond of Rs.15,000/­ along with surety of
like amount in connection with C.R. No. 133/2022 registered
with Antop Hill Police station for the offence punishable under
Sections 392, 504 r/w 34 of Indian Penal Code.

Applicant/accused shall furnish his residential address proof and
contact numbers to Investigating Officer.

4.

Applicant/accused shall mark his attendance at Antop Hill police
station on each Monday between 11.00 a.m. to 2.00 p.m. till
filing of charge­sheet.

The applicant/accused shall not directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts
to the Court or to any Police Officer.

6.

Applicant/accused shall not leave India without the previous
permission of the Court.

7.

Bail before Lower Court.

8.

Criminal Bail Application No.940 of 2022 stands disposed of
accordingly.
